Terms of Service

By accessing or using GemKit Studio (“the Service”) at gemkitstudio.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Kaan Mutafoglu (“we”, “us”).

GemKit Studio is an AI-powered tool for jewelry sellers that automates product classification, studio image generation, video creation, listing copywriting, and publishing to third-party marketplaces including Etsy and Shopify. The Service is provided on a credit-based subscription model.

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 18 years old to use the Service.
• You may not create more than one account per person without our written permission.
• You are responsible for all activity that occurs under your account.

• The Service operates on a prepaid credit system. Each AI operation consumes a defined number of credits.
• New accounts receive 100 free credits on signup.
• Purchased credits are non-refundable except where required by applicable law.
• We may change credit prices with 30 days' notice.
• Credits have no cash value and cannot be transferred between accounts.

You agree not to:

• Upload content that violates any law, infringes intellectual property rights, or depicts illegal activity.
• Use the Service to create counterfeit or misleading product listings.
• Attempt to reverse-engineer, scrape, or abuse the Service's APIs or AI systems.
• Circumvent rate limits or credit checks.
• Share your account credentials or allow unauthorized access to your workspace.
• Use the Service in any way that violates Etsy's, Shopify's, or any other marketplace's Terms of Service.

When you connect your Etsy or Shopify store, you remain responsible for ensuring that all content published via GemKit Studio complies with those platforms' policies, including their listing rules, image policies, and seller agreements. GemKit Studio is not liable for any violation of marketplace policies that results from content you generate and publish through the Service.

The term “Etsy” is a trademark of Etsy, Inc. GemKit Studio uses the Etsy API but is not endorsed or certified by Etsy, Inc.

• Your content: You retain ownership of all product photos you upload and all AI-generated content produced from them within your workspace.
• Our content: The GemKit Studio platform, software, UI, and all associated intellectual property belong to us. You may not copy, modify, or distribute our software.
• License to us: By uploading content, you grant us a limited, non-exclusive license to process and store it solely to provide the Service to you.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES — YOU ARE RESPONSIBLE FOR REVIEWING AND APPROVING ALL CONTENT BEFORE PUBLISHING.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us at mutafoglukaan@gmail.com. Upon termination, your data will be deleted per our Privacy Policy.

We may update these Terms with 14 days' notice for material changes (via email or in-app notification). Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey, unless prohibited by applicable consumer protection law in your jurisdiction.
